ELECTRONIC RECORDS DISCLOSURE AND AGREEMENT
Electronic Copy of Related Disclosures, Agreements, and Instructions. In order to speed up the loan application process, with your consent, RateGenius, its network of lenders, lending partners, and third-parties ("Lender Network") will provide you with the following information electronically, rather than by postal mail or in person:
- A loan application and all related disclosures required by applicable federal and state law for the loan you have selected; and
- Information and instructions about any additional services that you select during the application process.
Your Consent is Required. You must consent to receiving the related legal disclosures, agreements, and instructions before they can be provided to you electronically. Your consent will only apply to the loan and related products you have selected and their related legal disclosures, agreements and instructions. You will not be consenting to receiving other electronic records or disclosures at this time.
Paper Copy of Disclosures, Agreements and Instructions. If you do not want to receive the legal disclosures, agreements and the instructions electronically, you should exit this area of our website. If you consent to receive the disclosures, agreements and instructions electronically, you can also request a paper copy of the related legal disclosures, agreements and instructions. RateGenius will not charge you any fees for providing a paper copy of the disclosures, agreements and instructions.
Withdrawal of Consent for Electronic Delivery. You may withdraw consent for electronic delivery of legal disclosures, agreements, instructions, and communications, but doing so will not affect the legal effectiveness, validity or enforceability of electronic records that were made available to you prior to the implementation of your withdrawal of consent for electronic delivery.
In the event that you withdraw your consent for electronic delivery, RateGenius will no longer be able to communicate with you electronically. To withdraw consent to electronic delivery, you must either: (i) write to us at RateGenius, Customer Service, 9300 United Drive, Suite 180, Austin, TX 78758; (ii) use a method that may be available to you at the RateGenius website www.rategenius.com; or (iii) contact Customer Service at 866-728-3436.
Updating Your Contact Information. To provide updated information on how RateGenius may contact you electronically, you must either: (i) write to us at RateGenius, Customer Service, 9300 United Drive, Suite 180, Austin, TX 78758; (ii) use a method that may be available to you at the RateGenius website www.rategenius.com; or (iii) contact Customer Service at 866-728-3436.
System Requirements to Access the Information. To receive an electronic copy of the legal disclosures, agreements, and instructions related to your loan and any related products, you must have the following equipment and software:
- You must have a personal computer or other access device that is capable of accessing the Internet (e.g., you must have a modem and available phone line, a cable Internet connection or some other means of access to the Internet, and you must have an active account with an Internet service provider).
- You must have an Internet web browser that is capable of supporting 128-bit SSL encrypted communications, which requires a minimum web browser version of either Microsoft® Internet Explorer version 6.0 or Netscape Navigator® version 4.73, and your system must have 128-bit SSL encryption software.
- You must have software that permits you to receive and access Portable Document Format or "PDF" files, such as Adobe Acrobat Reader® version 5.1 or higher, which is available for download at Adobe's website.
System Requirements to Retain the Information. To retain a copy of the requested file, your system must have the ability to either download (e.g., to your hard disk drive or a floppy diskette) or print PDF files. You must have a functioning printer connected to your personal computer or other access device that is able to print the related legal disclosures, agreements, the instructions, communications, and online statements on plain white 8 1/2" x 11" paper.
Agreements and Acknowledgments. By submitting your application through RateGenius’ website, you represent that: (i) you have read, understand and agree to all of the provisions of this Electronic Records Disclosure and Agreement (the "Agreement"); and (ii) you represent that the Internet access device(s) you will use to receive this Agreement and related legal disclosures, agreements, instructions, communications and online statements meet(s) the system requirements to access information and to retain information as stated in the previous two sections.

Requirements for your application to be considered by RateGenius:
- Must be 18 years old or older
- Current loan balance of $10,000 or greater
- Vehicle must be no older than 12 years
- Vehicle must have less than 150,000 miles
- Combined household income of $2000/mo. or more
If you do not meet the above criteria, please do not submit this application. By submitting this application through RateGenius, you represent that you have read, understand, and agree to the following Terms of Use. If a joint application is filed, these Terms of Use apply to each of the applicants equally:
- You represent that the information that you have provided in the application process is true and complete, and that you are over the age of 18 and have the power and authority to enter into and perform your obligations under any credit arrangement that may be offered;
- You acknowledge that you may withdraw your application at any time prior to executing any loan agreement;
- You authorize RateGenius to pull your credit report for the purpose of evaluating your credit options for financing your loan through RateGenius’ network of lenders, lending partners, and third-parties ("Lender Network");
- You consent to the sharing of the information you have provided in the application and any credit reports obtained by RateGenius with one or more parties in the Lender Network;
- You authorize any party in the Lender Network, to which RateGenius has submitted your application for credit, to pull your credit report in order to evaluate your application;
- You acknowledge that RateGenius and any party in the Lender Network may retain your loan application information in order to comply with certain federal and state laws and regulations;
- You acknowledge that you have read the RateGenius Privacy Policy;
- You acknowledge that RateGenius does not guarantee that a lender will make you an offer to finance your loan;
- You acknowledge that RateGenius does not guarantee that a lender will finance your loan at specific terms and conditions, including a specific interest rate;
- You acknowledge that RateGenius is not responsible for any errors or delays related to your application caused by incorrect information provided by you or other technical problems beyond its reasonable control;
- You may consent to receive notices electronically and agree to receive such notices at RateGenius' website. These notices may include privacy notices and information required by the Equal Credit Opportunity Act;
- You acknowledge that the services offered by RateGenius are available only to residents of, or secured by collateral located in, those states where RateGenius is licensed (if licensing is required) and those states where any party in our Lender Network are licensed or authorized to make such loans;
- You acknowledge that under no circumstances will RateGenius be liable to you or to any other person for any indirect, incidental, consequential, or punitive damages arising out of or relating to this agreement. Your sole and exclusive remedy hereunder will be for you to discontinue your use of our services and terminate this agreement; and
- You acknowledge that this agreement shall be subject to the laws of the State of Texas, excluding its conflict of law principles.
CUSTOMER COMMUNICATIONS: By accepting these Terms of Use, you expressly consent to be contacted by RateGenius, its agents, representatives, affiliates, or any party in the Lender Network for any and all purposes related to your application and any related loan, at any telephone number, or physical or electronic address you provide or at which you may be reached. You agree that RateGenius, its agents, representatives, affiliates, or any party in the Lender Network may contact you in any way, including SMS messages (including text messages), calls using prerecorded messages or artificial voice, and calls and messages delivered using auto telephone dialing system or an automatic texting system. Automated messages may be played when the telephone is answered, whether by you or someone else. In the event that an agent or representative calls, he or she may also leave a message on your answering machine, voice mail, or send one via text. You consent to having all calls between you and RateGenius recorded for quality assurance. You consent to receive SMS messages (including text messages), calls and messages (including prerecorded and artificial voice and autodialed) from RateGenius, its agents, representatives, affiliates or party in the Lender Network at the specific number(s) you have provided to RateGenius, or numbers it can reasonably associate with your account (through skip trace, caller ID capture or other means), with information or questions about your application, loan and/or account. You certify, warrant and represent that the telephone numbers that you have provided to RateGenius are your numbers and not someone else's. You represent that you are permitted to receive calls at each of the telephone numbers you have provided to us. You agree to alert RateGenius whenever you stop using a particular telephone number. You also understand that your cellular or mobile telephone provider will charge you according to the type of plan you carry.
CONSUMER NOTICES BY STATE
Notice to California Residents: If married, you may apply for credit separately as an individual.
Notice to Maine Residents: You must have physical damage insurance covering loss or damage 1.0 the vehicle for the term of any loan. You may buy this insurance from anyone you choose. You do not have to buy it from someone affiliated with the lender. Your choice of insurance will not affect the credit approval process unless the insurance does not satisfy the contract requirements or the insurance company does not satisfy the reasonable standards of the dealer or an assignee of the contract.
Notice to New Hampshire Residents: If this is an application for a balloon contract, you are entitled to receive, upon request, a written estimate of the monthly payment amount that would be required to refinance the balloon payment at the time such payment is due based on your current refinancing programs. A balloon contract is an installment sale contract with a final scheduled payment that is at least twice the amount of one of the earlier scheduled equal periodic installment payments.
Notice to New York Residents: Consumer reports may be requested in connection with this application. Upon request, you will be informed whether or not a consumer report was requested and, if it was, of the name and address of the consumer reporting agency that furnished the report. Additional consumer reports may be requested with respect to any extension or renewal of this obligation.
Notice to Ohio Residents: The Ohio laws against discrimination require that all creditors make credit equally available to all creditworthy customers, and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio Civil Rights Commission administers compliance with this law.
Notice to Rhode Island Residents: Credit Reports may be obtained in connect ion with this application for credit.
Note to Vermont Residents: You authorize us and any financial service provider with whom this application is shared, to obtain credit reports to evaluate your credit application. If your application is approved and credit is granted, you also authorize all parties granting credit, holding and/or servicing your account, to obtain additional credit reports in connection with your account, as permitted by law.
Notice to Wisconsin Residents: The interest of the creditor will not be adversely affected by a provision of a marital property agreement, a unilateral statement under Wisconsin Statutes § 766.59 or a court decree under Wisconsin Statue § 766.70, unless you furnish a copy of such agreement, statement or decree to the creditor, or the creditor has actual knowledge of such provision before credit is granted.

RateGenius, Inc. (“RateGenius,” “we,” “our,” or “us”) respects the privacy of your information. This Privacy Policy is designed to assist you in understanding how we collect, use and safeguard the information you provide to us in using our websites (the “Sites”) and the services provided through our Sites (the “Services”).
RateGenius is headquartered in Austin, Texas. It is licensed as a registered lender with the Texas Office of Consumer Credit Commissioner and is a proud member of the Better Business Bureau. All lenders in the RateGenius network are well-established FDIC-insured banks, thrifts or licensed lenders.
From time to time, we may change this Privacy Policy. If we do, we will post an amended version on this webpage. Please review this Privacy Policy periodically. Your continued use of the Sites and Services after any such amendment signifies your acceptance thereof.
COLLECTING AND USING INFORMATION
Personally Identifiable Information We Collect Online
Through your use of the Sites and Services, we may collect Personally Identifiable Information from you. “Personally Identifiable Information” is individually identifiable information about an individual consumer that we collect online and that we maintain in an accessible form.
Information You Provide
We may collect the following Personally Identifiable Information that you voluntarily provide to us:
- Apply Now. When you apply to refinance your auto loan, you will provide us with Personally Identifiable Information such as your first and last name, telephone number, email address, and physical address. You also will provide us with information relating to your vehicle (such as its year, make, model, trim, and estimated number of miles), information relating to your current loan (such as the name of your current auto lender and current monthly auto payment), information relating to your current residence (such as the type of residence and your monthly payment), information regarding your employment and income, and your date of birth. You also may voluntarily agree to provide us with your Social Security number. If you respond to an offer in the mail to refinance your auto loan, you will provide your pre-qualification code and zip code.
- Prequalification. When you explore your options with our “Get Prequalified” you will provide us with Personally Identifiable Information such as your first and last name and physical address. You also will provide us with other information such as your date of birth, yearly income, monthly vehicle payments, and vehicle year.
- Careers. If you apply for a job using our “Careers” feature, you will provide your first and last name, email address, phone number, resume and cover letter. By applying for a job through this feature, you will be directed to a third-party website hosted by JazzHR. You also will be asked to provide other information such as why this opportunity excites you and whether you will need a visa sponsorship. JazzHR’s privacy policy is available at https://www.jazzhr.com/privacy-policy/. If you choose to use the “Remind Me To Apply Later” feature, you will provide your email address.
- Refinancing Chat. If you engage with our RateGenius Chat powered by LiveChat, we may collect your name, email address and any other Personally Identifiable Information you voluntarily provide. LiveChat’s privacy policy can be found at https://www.livechat.com/legal/privacy-policy/.
- Contact Us. If you contact us through the Sites, we may collect your name, email address, and telephone number along with any other Personally Identifiable Information you voluntarily provide.
- Interact with our Sites or Services. When you send us any feedback, questions, comments, suggestions, ideas, or interact with us in any way, you may need to provide us with your log-in information, name and/or email address.
Information as You Navigate Our Sites
We automatically collect certain Personally Identifiable Information through your use of the Sites and Services, such as the following:
- Usage Information. We collect information such as which of the pages on the Sites you access, the frequency of access, and what you click on while on the Sites.
- Device Information. We collect information about the device you are using, such as hardware model, operating system, application version number, and browser.
- Mobile Device Information. In addition to the Device Information listed above, when you access our Sites via a browser on your mobile device, we collect and aggregate information about whether you are accessing the Sites via a mobile device or tablet, device type, and carrier.
- Location Information. We collect location information from Site visitors on a city-regional basis.
Third Party Information
In some cases, we may receive certain Personally Identifiable Information from you about a third party. For example, if you choose to use the “Remind Me To Apply Later Feature” on our Careers page, you may provide us with the email address of a third-party. If you submit any Personally Identifiable Information about another individual to us, you are responsible for making sure that you have the authority to do so and to allow us to use their Personally Identifiable Information in accordance with this Privacy Policy.
Information from Other Sources
When you apply for a loan, we may obtain Personally Identifiable Information about you from other sources, such as information about your credit profile or other information from Experian, TransUnion, and Equifax. We also may collect information about you from other sources to verify the information you provided in your loan application.
How We Use Your Personally Identifiable Information
We use the Personally Identifiable Information we collect to provide the Services to you, to improve our Services and Sites, and to protect our legal rights. In addition, we may use the Personally Identifiable Information we collect to:
- Find you the best possible interest rate from our lender base;
- Review your job application;
- Send you notifications of our latest news and updates if you voluntarily elect to receive them;
- Communicate with you via telephone, mobile devices, email or postal mail about our products and services that we feel may be of interest to you;
- Research and analyze other products and services offered by RateGenius or others that may save you money;
- Deliver relevant advertising and analyze the effectiveness of RateGenius advertising and other campaigns;
- Communicate with you about our Sites or Services or to inform you of any changes to our Sites or Services;
- Provide support;
- Maintain and improve our Sites and Services;
- Defend our legal rights and the rights of others;
- Efficiently maintain our business; and
- Comply with applicable law.
How We Share Your Personally Identifiable Information
We may share the Personally Identifiable Information that we collect about you in the following ways:
- RateGenius and Affiliates. We may share your Personally Identifiable Information with RateGenius subsidiaries and affiliates. These subsidiaries and affiliated adhere to this Privacy Policy.
- Lenders. Once you have submitted an application, RateGenius will begin the process of finding you the best possible interest rate from our lender base of over 200 financial institutions. Your Personally Identifiable Information is not sent to each lender in our network for review. Instead, your credit profile and needs are matched to the borrower profile established by our lenders and sent to those lenders first. By submitting an application to RateGenius, you consent to the use of your credit report for the purpose of obtaining a credit offer from one of our participating lenders.
- To Comply with the Law. We may disclose Personally Identifiable Information we collect if we determine in our sole discretion that such disclosure is necessary to comply with the law, including disclosure to law enforcement agencies and other government agencies and disclosure responsive to subpoenas. We also may disclose information we collect if we deem it necessary to protect the rights, property, or safety of RateGenius, our customers or others; in connection with any legal proceedings or prospective legal proceedings; and to any person who we reasonably believe may apply to a court or other competent authority for disclosure of that Personally Identifiable Information where, in our reasonable opinion, such court or authority would be reasonably likely to order disclosure of that Personally Identifiable Information.
- To Third Parties. We may disclose your Personally Identifiable Information to third party vendors that provide services to RateGenius to process your information for purposes of reviewing your loan application. We may disclose the information we collect to companies that perform marketing services on our behalf, with which we have joint marketing agreements, or with which we have other agreements that, among other things, require the safeguarding of your information. Also, RateGenius may disclose your Personally Identifiable Information to third parties that are interested in contacting you or providing offers to you that may be related to our products and services or about products or services you may find of interest, and we may be compensated for such disclosure. You can, at any time, opt-out of our ability to share information with unaffiliated third parties that do not provide services to RateGenius for processing your loan application by contacting customer service at 866-728-3436.
- Advertising. We may disclose your Personally Identifiable Information to service providers to prepare, deploy, and analyze advertising content.
- Sale of Assets. We may disclose your Personally Identifiable Information to any other person or entity as part of any business or asset sale.
- Consent. We may disclose your Personally Identifiable Information to any other person or entity where you consent to the disclosure.

How We Use Cookies
Like many other companies, we use cookies and other tracking technologies (such as pixels and web beacons) (collectively, “Cookies”). “Cookies” are small files of information that are stored by your web browser software on your computer hard drive, mobile or other devices (e.g., smartphones or tablets).
We use Cookies to:
- Estimate audience size and usage patterns;
- Understand and save your preferences for future visits, allowing us to customize the Sites and Services to your individual needs;

OneSignal
We use OneSignal to send you push notifications if you voluntarily agree to receive them. OneSignal collects the following types of information from end users: mobile advertising identifiers, email addresses, IP addresses, device push tokens, precise location (e.g., GPS-level) data, network information, language, time zone, product preferences, and privacy preferences. The information collected by OneSignal is subject to OneSignal’s privacy policy, which is available here. If you no longer wish to receive these push notifications, you can block them using the Notifications settings in your browser.
“Do Not Track” Signals
Some internet browsers incorporate a “Do Not Track” feature that signals to websites you visit that you do not want to have your online activity tracked. Given that there is not a uniform way that browsers communicate the “Do Not Track” signal, the Sites do not currently interpret, respond to or alter their practices when they receive “Do Not Track” signals.

SECURITY
We maintain commercially reasonable security measures to protect the Personally Identifiable Information we collect and store from loss, misuse, destruction, or unauthorized access. However, no security measure or modality of data transmission over the Internet is 100% secure. Although we strive to use commercially acceptable means to protect your Personally Identifiable Information, we cannot guarantee absolute security.
THIRD PARTY LINKS
The Sites may contain links that will let you leave the Sites and access another website. Linked websites are not under our control. Except as stated below, this Privacy Policy applies solely to Personally Identifiable Information that is acquired by us on the Sites. We accept no responsibility or liability for these other websites.
CHILDREN’S PRIVACY
The Sites are not intended for children under 13 years of age. We do not knowingly collect, use, or disclose personal information from children under 13.
NOTICE TO NEVADA RESIDENTS
Nevada law allows Nevada residents to opt-out of the sale of certain types of personal information. Subject to several exceptions, Nevada law defines “sale” to mean the exchange of certain types of personal information for monetary consideration to a person for the person to license or sell the information to additional persons. We do not currently sell personal information as defined in the Nevada law. However, if you are a Nevada resident, you still may submit a verified request to opt-out of sales and we will record your instructions and incorporate them in the future if our policy changes. NOTICE TO CALIFORNIA RESIDENTS
The California Consumer Privacy Act (CCPA) requires that we provide California residents with a privacy policy that contains a comprehensive description of our online and offline practices regarding the collection, use, disclosure, and sale of personal information and of the rights of California residents regarding their personal information. This section of the Privacy Policy is intended solely for, and is applicable only as to, California residents. If you are not a California resident, this does not apply to you and you should not rely on it.
The CCPA defines “personal information” to mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California resident or household. Personal information does not include information publicly available, deidentified or aggregated information. For purposes of this “NOTICE TO CALIFORNIA RESIDENTS” section we will refer to this information as “Personal Information.”

We collected the above Personal Information for the following business or commercial purposes:
- Auditing related to a current interaction with the consumer and concurrent transactions, including, but not limited to, counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards

In addition, when you apply for a loan using our Services, you must agree to our Terms of Use, in which you will consent to the disclosure of your Personal Information to other entities, such as financial institutions, as part of your application process. In so doing, you are directing us to intentionally disclose your personal information and using us to intentionally interact with third parties. If you do not consent to these transfers, do not use our Services.
We do not knowingly collect or sell the Personal Information of minors under 16 years of age.
Right to Request Deletion of Personal Information
If you are a California resident, you have the right to request that we delete the Personal Information about you that we have collected or maintain. However, per the CCPA, we are not required to comply with a request to delete if it is necessary for us to maintain the Personal Information in order to, for example, complete a transaction, detect security incidents, comply with a legal obligation, or otherwise use the Personal Information, internally, in a lawful manner that is compatible with the context in which you provided the information.
How to Submit a Request to Know or Delete
You may submit a request to know or delete by completing our online request form available here, emailing privacy@rategenius.com or by calling us at (855) 350-7900. If you submit a request to delete online, you may be asked to confirm separately that you want your Personal Information deleted.
Our Process for Verifying a Request to Know or Delete
We will comply with your request upon verification of your identity and, to the extent applicable, the identity of the California resident on whose behalf you are making such request.
For requests to access categories of Personal Information and for requests to delete Personal Information that is not sensitive and does not pose a risk of harm by unauthorized deletion, we will verify your identity to a “reasonable degree of certainty” by verifying at least two data points that you previously provided to us and which we have determined to be reliable for the purpose of verifying identities.
For requests to access specific pieces of Personal Information or for requests to delete Personal Information that is sensitive and poses a risk of harm by unauthorized deletion, we will verify your identity to a “reasonably high degree of certainty” by verifying at least three pieces of Personal Information previously provided to us and which we have determined to be reliable for the purpose of verifying identities. In addition, you will be required to submit a signed declaration under penalty of perjury stating that you are the individual whose Personal Information is being requested.
Right to Opt-Out of Sale of Personal Information
If you are a California resident, you have the right to direct us to stop selling your Personal Information. To opt-out of our use of third-party advertising Cookies, please see the section “How You Can Opt-Out of Cookies” above. Right to Non-Discrimination for the Exercise of a California Resident’s Privacy Rights
We will not discriminate against California residents if they exercise any of the rights provided in the CCPA as described in this section “Notice to California Residents.” As such, we will not deny goods or services to that California resident; charge different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties; provide a different level or quality of goods or services to the California resident; or suggest that the California resident will receive a different price or rate for goods or services or a different level or quality of goods or services. However, we are permitted to charge a California resident a different price or rate, or provide a different level or quality of goods or services, if that difference is reasonably related to the value provided to us by the individual’s data.

If you are submitting a request on behalf of a California resident, please submit the request through one of the designated methods discussed above. After submitting the request, we will require additional information to verify your authority to act on behalf of the California resident.
Shine the Light Law
If you are a California resident, California Civil Code § 1798.83 permits you to request information regarding the disclosure of your personal information by us to third parties for the third-parties’ direct marketing purposes (as those terms are defined in that statute).
